Terms of use and sale

The French version is the reference version. This English version is adapted for international users. It does not waive mandatory consumer rights available under local law.

These terms govern the Nudge application and Nudge Gold subscription.

1. Provider

Nudge is provided by Arthur Musso Fournier, sole trader (Entrepreneur individuel, EI), trading as Nudge, 59 rue de Ponthieu, Bureau 326, 75008 Paris, France.

2. Acceptance

Using Nudge means accepting these terms. A subscription is also subject to the offer shown in the app and App Store at checkout and to Apple’s mandatory purchasing terms.

The App Store offer controls the actual price, currency, trial and billing period. Mandatory consumer law always prevails over conflicting language. Users should retain a copy of the terms in effect at purchase.

3. Age

Nudge is only for people aged 16 or older. Users represent that they meet this age and have legal capacity to accept these terms or any legally required permission from a guardian.

4. Service

Nudge lets users select a screenshot or text, receive an automated analysis and generate suggested replies. Users may adjust style settings, keep local history and optionally enable iCloud backup.

Nudge does not automatically read all messages or photographs and does not send messages on the user’s behalf. The user chooses what to import, reviews every result and decides whether to copy, edit, send or ignore it.

The service requires a compatible Apple device, a supported iOS version and internet access for AI features. Some functions require an available Apple Account and iCloud service. Current compatibility appears on the App Store product page.

5. AI outputs

Analyses and suggestions are generated automatically. They may be inaccurate, incomplete, biased, awkward, offensive or unsuitable. Nudge cannot know facts or intentions absent from the submitted content.

Outputs are not legal, medical, psychological, financial or other professional advice. They do not guarantee any relationship outcome and must not be used for decisions seriously affecting another person’s safety, rights or welfare.

Users must exercise judgment, review each suggestion and remain responsible for messages they choose to send.

6. Submitted content

Users retain their rights in submitted screenshots and text. They grant Nudge a non-exclusive, worldwide, royalty-free permission limited to the time and technical operations necessary to provide and secure the requested feature and, if enabled, synchronise information to the user’s private iCloud space.

Users must have legitimate access to submitted content. They should submit only what is useful and, where reasonably possible, hide unnecessary contact details, sensitive data, intimate information and third-party details.

This permission does not allow Nudge to sell conversation content or use it for advertising.

7. Prohibited uses

Users must not use Nudge to harass, threaten, monitor, intimidate, blackmail or harm anyone; impersonate or fraudulently deceive a person; facilitate violence, exploitation, discrimination or unlawful conduct; sexualise a minor or process sexual content involving a minor; violate privacy, confidentiality or intellectual-property rights; bypass quotas, subscription checks or security controls; resell, automate or reverse engineer the service except where mandatory law permits; introduce malware; or disrupt the infrastructure.

8. Free access

Nudge may provide a demonstration or limited free analyses and generations. Displayed limits form part of the free service and may change prospectively. Free access has no cash value, is non-transferable and may be limited per device to prevent circumvention.

9. Nudge Gold

Nudge Gold provides the paid features described at subscription time and ongoing access to the online service and its updates.

Indicative French prices are €9.99 per month and €49.99 per year. These amounts remain indicative until configured and approved in the App Store. The localised price, taxes, currency and billing period displayed by Apple at checkout control and may vary by country.

10. Free trial

Apple may offer an eligible user a three-day free trial. Apple determines eligibility. Unless cancelled before it ends, the trial automatically converts to the selected paid subscription at the price and interval displayed at checkout. If no trial appears, billing starts when the purchase is confirmed.

11. Billing and renewal

Purchases are confirmed and charged through the user’s Apple Account. Apple handles payment, billing and applicable taxes.

Subscriptions renew automatically for the same period until cancelled. Users should normally cancel at least 24 hours before the end of the current period to avoid the next renewal. Price changes are handled under Apple’s rules and applicable law and may require advance notice or consent.

12. Cancellation and restoration

Subscriptions can be managed or cancelled through Apple Account settings or the subscription-management link in Nudge. Deleting Nudge or its data does not cancel a subscription.

After cancellation, paid access normally continues until the end of the paid period unless Apple grants a refund or applies another rule. “Restore purchases” retrieves eligible purchases associated with the Apple Account.

13. Withdrawal and refunds

Consumers may have a statutory withdrawal right depending on their country. Apple presents the applicable purchasing information and handles App Store refund requests through its procedures.

French consumers generally have a fourteen-day withdrawal period for distance contracts, subject to special rules when immediate performance of a service or supply of digital content begins with express agreement. Loss of that right can occur only under the conditions required by law.

For in-app purchases distributed through the App Store, Apple acts, depending on the territory, as agent or commissionaire for marketing and delivery. Refund or withdrawal requests relating to the transaction should first be submitted to Apple. Nudge will cooperate in handling those requests, and consumers may also contact Nudge where a right concerns the service supplied.

App Store purchase issues can be submitted at reportaproblem.apple.com. This does not limit mandatory rights.

14. Digital-service conformity

European and French consumers benefit from mandatory legal conformity rights for digital content and services. Nudge must match its contractual description, provide advertised functions and qualities, be fit for the ordinary purpose of a comparable service, and receive updates necessary to maintain conformity for the applicable period.

Where Nudge is non-conforming, consumers may request conformity without charge, undue delay or major inconvenience. Where conformity is impossible, refused, delayed, remains defective or the defect is sufficiently serious, the consumer may be entitled to a price reduction or termination under applicable law.

Claims may be sent to hello@asknudge.app with the issue, app version and optional support identifier. Nudge may direct users to Apple for billing operations without removing rights against the legally responsible trader.

Nothing in these terms excludes a mandatory warranty or remedy.

15. Intellectual property

The application, code, interface, text, illustrations, animations, trademarks and graphics are protected by intellectual-property rights belonging to Nudge or their respective owners.

Subject to these terms, users receive a personal, limited, non-exclusive, non-transferable and revocable licence to use Nudge on compatible devices for personal purposes.

Because of the nature of AI, Nudge does not guarantee that an output is original or subject to exclusive rights. Similar outputs may be provided to others. Users must ensure their use does not infringe third-party rights.

16. Availability and updates

Nudge uses reasonable efforts to operate the service but does not promise uninterrupted or error-free availability. Maintenance, security work, networks, Apple or providers may cause interruptions.

Updates may correct errors, improve security or change features. Some may be necessary for continuing conformity and operation. Failure to install a properly disclosed update may affect the service to the extent permitted by law.

17. Suspension

Nudge may limit or suspend access where it reasonably suspects fraud, circumvention, attack, prohibited use or a legal obligation. Where appropriate and possible, the user will be informed and may contact support. Suspension does not remove consumer remedies for a non-conforming paid service.

18. Liability and disclaimers

Each party is responsible for direct loss caused by its breach under applicable law. Users remain responsible for messages they send and content submitted without permission.

To the extent permitted by law, Nudge is not liable for indirect or unforeseeable loss, or unavailability exclusively caused by the device, network, Apple, another provider or force majeure. These limitations do not apply to fraud, gross negligence, personal injury, breach of an essential obligation or where limitation is prohibited.

For US users, Nudge is provided on an “as available” basis and implied warranties are disclaimed only to the maximum extent allowed by the user’s state law. Some states do not permit certain exclusions or limitations, so they may not apply.

19. Changes and discontinuation

Nudge may evolve the service and these terms. Material changes affecting an active subscription or user rights will be communicated within a reasonable period and will include cancellation rights where required.

If a paid feature is permanently discontinued, active subscriptions will be handled under mandatory law and available App Store mechanisms.

20. Force majeure

Neither party is responsible for failure caused by an event reasonably beyond its control that meets the applicable legal definition of force majeure. Affected obligations are suspended while the event continues, without removing mandatory consumer rights.

21. Complaints and consumer mediation

Complaints should first be sent to hello@asknudge.app.

After an unresolved written complaint, eligible consumers will be able to use Nudge’s appointed French consumer mediator free of charge.

Nudge’s consumer mediator is currently being appointed. Its contact details and submission procedure will be published on this page once membership has been finalised and, at the latest, before paid subscriptions become commercially available to consumers.

Mediation is voluntary for consumers and does not prevent court proceedings.

22. Governing law

French law governs these terms. This choice does not deprive consumers of mandatory protections in their country or US state of residence.

Courts are determined under applicable mandatory rules. These terms do not require consumers to bring claims exclusively in a distant forum where that requirement is prohibited. They do not impose mandatory arbitration or a class-action waiver.

23. Apple terms

When Nudge is downloaded from the App Store:

  • these terms are between the user and Nudge’s publisher, not Apple, subject to Apple’s role in sale and billing;
  • Apple has no responsibility for maintaining or supporting Nudge;
  • for a failure covered by an applicable warranty, Apple may refund the price paid for the app to the extent required by its rules, with no other warranty obligation;
  • users represent that they are not in a country subject to an applicable US embargo and are not on a US prohibited or restricted-party list;
  • users must comply with applicable third-party service terms; and
  • Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.

The Apple Standard EULA also applies where relevant.

24. General provisions

If a provision is invalid, the remainder continues in effect. Failure to enforce a right immediately is not a waiver. Nudge will not assign the agreement in a way that unlawfully reduces consumer guarantees.
